Abstract

Criminal execution concerns the society not only from the point of view of the retributive will, but also from the side of the mandatory solidarity duty (Articles 2 and 3 of the Italian Constitution) which binds institutions and citizens. This duty entails the removal of the social weaknesses that often distinguish the offender's life both before the criminal event and during detention. That is why rehabilitation plays a fundamental role (Article 27, paragraph 3, of the Italian Constitution), as the starting point of a path in which the prisoner, the institutions and the community should try to rebuild the social bond and make freedom and equality effective for everybody. Therefore, the article will analyze the prison system along three lines (work, education, affectivity), highlighting the necessary interpenetration between the prison environment and the external community.
