L'esclusione dal lavoro degli ebrei italiani sotto il fascismo

Abstract

L’attuazione della legislazione antisemita fascista ha avuto profonde ripercussioni sui diritti di migliaia di lavoratori ebrei italiani, una dimensione che tuttavia rimane poco esplorata nella letteratura accademica. Questo saggio si propone di analizzare le principali istituzioni giuridiche e i meccanismi introdotti dalle leggi razziali del 1938, evidenziandone l’impatto strutturale. Inoltre, viene offerta una valutazione critica delle misure “riparatorie” adottate nel dopoguerra, mettendo in luce la loro frequente inefficacia, spesso dovuta all’approccio eccessivamente prudente di molte corti italiane nel periodo successivo al regime fascista.

The implementation of fascist anti-Semitic legislation had significant repercussions on the labour rights of thousands of Italian Jewish workers, yet this dimension remains largely neglected in scholarly literature. This essay aims to examine the key legal institutions and mechanisms introduced by the 1938 racial laws, shedding light on their structural impact. Furthermore, it critically assesses the post-war “reparatory” measures, highlighting their frequent ineffectiveness — often due to the overly cautious stance adopted by many Italian courts in the aftermath of fascism.
